Dave Root presented at Apportionment in a Post-Tort Reform World: Putting the Pieces Together, a CLE program hosted by the Georgia Defense Lawyers Association Education Committee. The program occurred on March 22, 2012 and examined the 2005 Tort Reform Act's impact on apportionment of fault in negligence cases. Dave Root specifically discussed the impact that McReynolds v. Krebs will have on apportionment.

David Overstreet co-presented a seminar to insureds in Florida, Georgia, Louisiana, Missouri, Mississippi, North Carolina, and Texas on claims practices under errors and omissions policies.

Clarity may be on the horizon with respect to application of Georgia's apportionment statute - O.C.G.A. § 51-12-33 - in negligent security premises liability cases.  Seven years after the enactment of the statute, and with continued disagreement within the State Bar and inconsistent rulings from the courts, the Georgia Supreme Court will get its first opportunity to provide clarity on this topic.

Paul Sperry, Patrick Norris, and Tyler Winton presented a program on contractual issues and common legal pitfalls related to building enclosure on Thursday, January 19, 2012 at a meeting for The Building Enclosure Council–Charleston. This three part program included presentations on "Mock Mediation: Can't We All Just Get Along?," "Green Building and Potential for Litigation Involving Building Enclosure," and "Common Insurance Policies and Typical Coverage Provided for Claims That Relate to The Building Enclosure."

When the Federal Deposit Insurance Corporation (FDIC) closes a bank and becomes receiver, it considers making claims against the bank's directors, officers, accountants, and attorneys. To our knowledge, the FDIC has not yet brought any claims against accountants or attorneys arising out of the many banks closed in the past couple of years. However, the FDIC has hired more in-house counsel to work on professional liability matters. For information and guidance on handling any such claims that may arise, we looked back at claims made by the Resolution Trust Corporation (RTC) during the savings and loan crisis.

In this paper, Michele Jones will first briefly discuss the FDIC's claim procedures. Then she reviews the history of FDIC and RTC claims against professionals. Finally she looks at relevant statutes and case law regarding possible defenses available in FDIC actions.

On September 8, 2011, Joe Kingma, Partner and head of the Firm's Commercial Litigation practice group, presented the Georgia Professional Liability Section's report on the Newell Recycling case to the Executive Committee of the State Bar of Georgia. The Georgia Supreme Court's Newell decision suggests that the statute of limitations for professional liability claims against lawyers, accountants, engineers, architects and the like is six years when there is a written contract. For the past 50 years Georgia decisions had consistently ruled that the statute of limitations was four years for claims against most of these professionals. The report had been compiled and edited by Carlock Copeland's Pete Werdesheim, who chaired the Section's subcommittee on this report. Kingma argued to the State Bar that the confusion raised by the Newell decision would increase professional liability litigation and make insurance more expensive and difficult to obtain. It could also encourage professionals to avoid written engagement letters. Kingma suggested that the Section draft a comprehensive Professional Liability Statute of Limitations and the State Bar agreed. The Bar wants the draft by November so it can gain the support of accountants, architects, and engineers and then seek passage in the Georgia Legislature in January of 2012. Pete Werdesheim chaired a subcommittee of the Professional Liability Section of the State Bar of Georgia, which submitted a report to the State Bar's Executive Committee on the status of the statute of limitations governing malpractice claims against lawyers.

Joe Kingma was interviewed for "25 years of learning," an article in CAMICO's newsletter, Impact, that explores the history and current climate of fraud-related claims. Based on his extensive experience as a professional liability attorney, Kingma discusses the current climate of fraud-related claims and how the economy is causing a rise in these claims.
